Grading
We'll base your grades on class attendance/participation (25%) and an open-book, take-home exam (75%). The exam will consist of three questions:
Appointing Justices
Selecting Cases
Deciding Cases
We'll ask you to select one question and respond with an answer no longer than five pages (including footnotes and/or references), double spaced with 1-inch margins, using 12-point Times New Roman font. Any reference style is acceptable, as long as your sources are identifiable.
It’s OK to use generative AI (e.g., ChatGPT) but if you incorporate any information it produces please cite it as you would any other source and include your prompts on a separate page at the end of your exam. Prompts do not count toward the five-page limit.
You will receive the exam on Monday, October 27, 2025 at 9 am. You must complete and return the exam by 9 am on Monday, November 3, 2025.
If these rules present problems, please contact Prof. Epstein at least one week prior to distribution of the exam. Otherwise, we will not read or give credit to an exam that violates these rules.
